Recently the U.S. Department of Housing and Urban Development (HUD) released new guidelines to providers of housing and real estate-related transactions. In these new guidelines, HUD addresses the use of criminal records to make a tenant leasing decision.
This new guidance is very similar to the Equal Employment Opportunity Commission’s (EEOC) Letter of Guidance to Employers from April 2012. HUD suggests that housing providers should not automatically disqualify a prospective tenant based on a particular criminal record, conviction, or arrest.
